*We ask you to read your contract in full. *The client will receive up to 4 hours of play from event start time or time discuss prior to event through text/email and this doesn't include set-up and breakdown time. Any additional time needed will be $50.00 per hour (must be discussed at least 3 days prior to event) 1. This soft play equipment has been received in good condition and will be returned in the same condition. 2. Customer agrees to allow Little Humans Play LLC the right to enter premises of customer at any time to repossess said soft play equipment. 3. Customer agrees to reimburse Little Humans Play LLC for all attorney fees, an amount not less than 50% of all sums due, court cost and expenses incurred by Little Humans Play LLC to enforce collection or to preserve or enforce rights under this contract. 4. Customer agrees not to loan, sublet or otherwise depose of soft play equipment or use it at any other location. 5. Customer agrees to pay in full the replacement cost, including labor, for all damages to soft play equipment. 6. If the soft play equipment is lost, stolen, or damaged beyond repair, the renter agrees to pay up to $5000.00 (Five thousand dollars and 0 cents). 7. Customer agrees to ensure that all users (and users’ guardians) of the rental go over and read all rules. 8. THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS EITHER EXPRESSED OR IMPLIED. The person/s or organization renting this Soft Play Equipment from Little Humans Play LLC will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever. I have read the above agreement and fully understand and accept the conditions as above. I am aware that while in my care I am fully responsible for the soft play equipment and will pay for any loss or damages that may occur. 9. Lessee understands and acknowledges that soft play entails both known and unknown risks including, but not limited to, physical injury from falling, slipping, crashing or colliding, emotional injury, paralysis, distress, damage or death to any participant. Lessee agrees to indemnify and hold Little Humans Play LLC harmless from any and all claims, actions, suits, proceedings, costs, expenses, fees, damages and liabilities, including, but not limited to, reasonable attorney’s fees and costs, arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of the leased equipment. This includes, but is not limited to, the manufacture, selection, delivery, possession, use, operation, or return of the equipment. Lessee hereby releases and holds harmless Little Humans Play LLC from injuries or damages incurred as a result of the use of the soft play equipment. Little Humans Play LLC cannot, under any circumstances, be held liable for injuries as a result of inappropriate use, God, nature, or other conditions beyond its control or knowledge. Lessee also agrees to indemnify and hold harmless Little Humans Play LLC from any loss, damage, theft or destruction of the soft play equipment during the term of the rental and any extensions thereof. Little Humans Play, LLC Waiver of LIABILITY | Rules and Safe Procedures Release and Waiver Liability This is a legal document between the client "the renter" and “Little Humans Play, LLC” which affects your legal rights, so please read carefully. The renter desires to rent from Little Humans Play , LLC equipment to be used by the renter, his/her guests, invites or other individuals while in renters’ possession. Renter understands that use of this soft play equipment, bounce house, and other equipment may, by its nature cause injury or harm to renter, his/her guests, invites or other individuals. The renter does hereby freely, voluntarily, and without duress executes this release under the following terms: 1. Waiver and Release: Renter understands and acknowledges that this release discharges Little Humans Play , LLC from any liability or claim that the renter may have against Little Humans Play, LLC AND AFFILIATES with respect to any bodily injury, personal injury, illness, death, or property damage that may result from the renters use and possession of Little Humans Play, LLC equipment. Renter does hereby release and forever discharges and hold harmless Little Humans Play , LLC and it's successors and assigns from any and all liability claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from renters possession and use of Little Humans Play, LLC equipment. 2. Insurance: Renter understands that insurance for liability, health, and medical or disability coverage in any way related to the rental of equipment under this agreement is the sole responsibility of the renter. 3. Indemnification: Renter/Client agrees that he/she will indemnify and hold Little Humans Play, LLC harmless from any liability resulting from the use of Little Humans Play, LLC equipment by renter, his/hers assigns, heirs, guests, invites or other individuals utilizing the equipment while in renter's possession. By receiving services rendered by Little Humans Play, LLC I forfeit all rights to bring a suit against Little Humans Play, LLC AND AFFILIATES for any reason. In return I will also make every effort to obey safety precautions as listed in within and explained to me verbally, in efforts to keep the Little Humans Play, LLC experience positive, I have heard the safety rules and understand that I will ask for clarifications when needed. Safety procedures/ Play Rules: • PLAY AT YOUR OWN RISK • Children must be supervised by an adult (18 yr old)/parent/guardian while in play area. • NO Shoes, SNEAKERS, FLIP FLOPS OR SANDALS allowed on mats (play area) • SOCKS MUST BE WORN AT ALL TIMES! • NO food, drinks or sweets, gum allowed in play area • NO diving in the ball pit • NO equipment should be removed from within play area • No uneven size difference of players • NO shoving, pushing, wrestling, piling or ruff play in play area. • Play areas are designed for children under 6 years ONLY. •ABSOLUTELY NO paint stain/ mess-prone (i.e., glitter, slime, messy arty, temporary tattoos, face paint etc.) are not allowed in soft play areas • No more than the recommended amount of players on unit at any time • All sharp objects must be removed before play (including pens, pencils, jewelry, knives, eyeglasses, bling on pockets etc. • DO NOT enter if you are pregnant or have physical problems The Renter/Client Understands that: 1. I am responsible for following the rules and safe procedures mentioned above by Little Humans Play, LLC in order to protect the equipment and provide a safe environment for me, my guests and any other individuals who will have access to Little Humans Play, LLC equipment while is in my possession. 2. I AGREE TO RELEASE, DEFEND, INDEMNIFY, NOT SUE AND HOLD HARM LESS Little Humans Play, L.L.C., their principals, officers, owners, employees, equipment manufacturers from any claims, damages, (including medical fees, attorney fees). Injuries (including disabilities, paralysis and death) and expenses arising out of or resulting from my voluntary attendance/ participation at Little Humans Play, LLC. 3. If there is any damaged or stolen soft play equipment I will be charged at an appropriate amount, i.e. cost of repair or replacement. 4. I also acknowledge the risks involved in Little Humans Play, LLC play areas. These include but are not limited to any CHOCKING HAZARDS, FALLING, BREAKING ETC. while in use. I understand that I am participating voluntarily, and that all risks have been made clear to me. Additionally, I do not have any conditions that will increase my likelihood of experiencing injuries while engaging in this activity. By accepting rendered services by Little Humans Play, LLC I forfeit all rights to bring a suit against Little Humans Play, LLC AND AFFILIATES for any reason. In return I will also make every effort to obey safety precautions as listed in writing and explained to me verbally, in efforts to keep the Little Humans Play experience positive, I have read, heard, and understand safety rules and understand that I will ask for clarification when needed. Small Bounce house limits are 150# total weight and/or 4 children. we recommend kid ages 5 and below...after inspection if we see there are any damages. The client is responsible for paying damage fees. damage fees may vary. There MUST be an adult watching bounce house when children are playing at ALL TIMES! Terms Retainers At time of booking, 50% of total balance for non refundable retainer and also a signed contract will be required to secure your requested event date. Remaining balance will be due ( 14 days) prior to your event and an invoice will be sent the day payment is due.Failure to pay balance 7 days prior will result in cancellation of the event. With NO REFUNDS!! *If booking is less than 10 days prior to the event date, the full amount will be due at the time of booking.

Retainers At time of booking, 50% of total balance for non refundable retainer and also a signed contract will be required to secure your requested event date. Remaining balance will be due ( 14 days) prior to your event and will be charged to the credit card on file. Failure to pay balance 7 days prior will result in cancellation of the event. With NO REFUNDS!! *If booking is less than 10 days prior to the event date, the full amount will be due at the time of booking. Cancellations For any reason you need to reschedule/cancel your reservation, please be sure to contact us as soon as possible at littlehumansplay@gmail.com. Cancellations are available with NO REFUNDS, but you are able to change your event date 365 days pass the original reservation date. You are only allowed to reschedule once in the 365 day timeframe. Cancellations less than 7 days will automatically result in cancelation of your event with the loss of your retainer. Retainers are NON-Refundable. Unless Little Humans Play LLC Cancels Your Event! Weather Conditions If you are hosting an outdoor event you assume ALL weather-related risks. However, “BEFORE SET UP” if it should rain, we will work with you on a solution BEFORE setting up. If you are not able to hold your party indoors, you can check for another date. *Once Little Humans Play LLC has started (once mats are in place) the event set up and it begins to storm on your event. Unfortunately, we would have to pack up your event EARLY and you will not be able to check for another date or receive any type of refund! Outdoor Bookings If you need setup at a park you will need to contact the park in advance to determine the requirements needed to set up. We are insured and can get a certificate if needed. We require 21 days notice for certificate request. We charge a $10 cleaning fee for outdoor usage and outdoor set up will require a shaded area or a suitable cover in the form of a canopy tent, or pavilion, as the equipment will get hot in direct sunlight. Tents can be rented for an additional charge. A tarp will be provided, but please make sure the ground is flat, dry and clear from glass and debris. We do not set up on dirt. (photo of set up area must be provided) Set Up/Take Down Renter is responsible for clearing all areas needed for equipment and must be present at the time of delivery AND pick up. Please allow between 1 to 2 hours set up and break down time depending on your package size. NO CONTACT/NO INDIVIDUALS are allowed in area of the set-up area during set up and break down due to maintain social distancing, safety, and precautions. We require clients and workers to wear masks at all times. Please make sure we have a proper parking space to deliver and pick-up equipment to avoid any additional fees! *Additional fees may apply, if we deliver via stairs or to venues located at long distances from the loading zone (including parks, large estates, or any location that presents delivery/pick up complications)! Equipment Cleaning Care To reduce the number of germs and therefore the spread of disease or illness we ask that you immediately disinfect any equipment that has come in contact with the following situations: Leaked soiled diapers, vomit, blood, or mucous. A disinfectant will be provided by Little Humans Play LLC to ensure proper sterilization that is safe for all, including the equipment. Damages & Excessive Dirt For the security/damage deposit we will hold your credit card on file. After we retrieve the rental from you we will inspect the equipment, if there is any damage a $100 fee will be charged with notice to the card on file. For excessive dirt there will be a $25 cleaning fee charged. travel clause Travel clause For outdoor events, we require a shaded area or a conopy to cover the play area. If you plan on setting up on grass, we require the grass to be dry. We will NOT set up on a wet surface. We keep your card on file due to any damages(acting as a security deposit) you will be notified if that will be the case after examining equipment. Major U.S (united states) Card Companies Clause We are now only accepting Major U.S (united states) card companies: Visa, Mastercard, Discover, American Express for future transactions. If in the event you lose money through a transaction during the process of purchase. Our company (Little Humans Play Mobile Soft Rental) are not reliable for financial damage or replacing funds lost for transactions.
